I have my son

Postby Jaxle67 » Sun Aug 12, 2012 10:19 am

[b][/bOk so my ex wife has accepted the fact that my son wants to live with me. She certainly doesnt like it it but realizes that she is no longer in control. My question is what is the first step to get the paperwork in order to show i have sole physical custody. A lawyer would be preferabale but is quite costly and she doesnt appear to try to fight it at all. Where do i start? Also in our divorce degree where it states the child support guidelines how do i go about getting that changed as well. Im looking forward to have my son with me and give him a good stable enviroment . I want to get the paperwork in order for my own peace of mind. Thanks Jesse

More than your own piece of mind, if you take your son and Stop paying support you are open to your ex changing her mind and asking for the support to be paid in the future.
Call around and ask some attorneys the cost to write up the paperwork. Get it done right.
...or I could be wrong.

You think it may be costly, and I have no idea...but you have your SON! Spend at all costs...and pay as needed...don't let a minor slip up cost you later. Caps said it right..

If she is in agreement, you may want to schedule an appointment with a mediator where you can work out the details. Probably, its best to not touch the child support issue right now - just get your kid.

If you can get a mediated settlement agreement, you or the mediator can take that to the judge to be signed off on. Once that happens, file for a modification of child support and you'll enjoy collecting some of the monies you've paid her over the years.

If you try and go for child support now, the whole thing may fall apart and mediating is a lot cheaper than hiring an attorney.

Nail down custody, let time pass to establish a solid successful status quo and THEN file for CS.

My question is what is the first step to get the paperwork in order to show i have sole physical custody.

I think your first step is to google and download the appropriate forms, I know in my state that are easily findable, and fill them out. Have all the relevant info recorded and in hand and then go discuss it with an attorney or two.

That's what I would do.

Getting all your info done before you go wasting attorneys time will save you time and money.
