NJ access to marital home

Postby SoontobeFree » Thu Jul 19, 2012 5:26 am

STBX will be moving out in a week or two. Both names are on the mortgage so she is part owner. She stopped getting her mail at the house as well and so did I.

Once she has moved out does she have free will to come into the house anytime she wants?? I plan to change the alarm code and remove her as a call person. Not changing locks.

Can I request she give notice before she can access the home to get what ever stuff she might need after she moves out?

In Florida, anyone with this type of scenario in any state?

Change the locks. Why wouldn't you change the locks? She moved out.

You do not want her coming and going at her pleasure, because she will do so only to create conflict. She isn't going to drop by when she is in a good mood, she will be all wound up whenever she comes over. Just because her name is on the mortgage does not prevent you from having exclusive use of the house and it's quiet enjoyment.

She should remove any and ALL her stuff when she moves, and you should prevent her further entry into the home by any means necessary - changing the locks and having the court assign exclusive use.

If she leaves something/needs something, you should arrange to drop it off at her place.
