CPS cannot take custody away from one parent and hand it to another unless the other parent concedes there is a problem or unless there is significant risk to children. That this is given to you means there is a finding that she has a serious issue or poses a risk.

Follow your lawyer's advise. If I understand your question properly, there is a hearing on the CPS action first. Then your lawyer is suggesting filing divorce second. If my understanding is correct, then it is very appropriate to let your ex get her butt handed to her due to her screw-ups first, it makes things easier in your divorce.

And again, if I didn't make my point earlier. don't do anything in your own life that could cloud the picture.

Steroids issue sounds very similar to the Roger Clemmons saga going on right now. Unless she has photos of needles hanging from your "behind" not likely.

Even then, pictures of needles don't tell what's in them. Unless you're also holding a clearly marked bottle visible in the photo or a spoon and lighter, a syringe could be used for any number of legal injectables, pet meds, refilling fountain pens, home science experiments or just a tool used in any random hobby.

Basically, if a person has access to take pictures of needles, they also have access to a) take the needles for testing to show what they've been used for or b) plant needles containing whatever they want to be found.
