The (un)enforcability of overnight clauses has been discussed a lot here.

They're a waste of time vigorously pursued by only the nutttiest of nuts.

Hold firm. No self respecting patriotic American would want to voluntarily give up their right to freely associate with who they choose and parent how they see fit.


Be sure to press for her to be prosecuted for the bigamy.

Definitely TRYING to make sure she gets punished for BIGAMY.Especially if it helps my case in court. We are just wondering now, if she will still be tried for bigamy if our divorce is finalized this June? Im thinking that she will still be in trouble regardless since she has been married to me and him since Decemeber 2011. HOW long does it take for a report to be processed and investigated??

Am I the only one strongly skeptical of any court actually prosecuting for bigamy when it can be blamed on some bureaucratic error? Oops! we're not in UT or AZ, right?

More to the point, you know that marriages are public records, do you have proof that she actually remarried? How good is your source and documentation, before you go tearing off into (I assume here) rarely travelled paths?

Its also gonna be hard to get anyone to listen! Any prosecutor is going to think you're simply a STBX trying to cause your spouse problems! It's really hard to get anyone to listen to you in the middle of a divorce! My NJ forged document, committed insurance fraud, broke in to my home, and took an ax to my truck! No charges were ever filed, in fact, the district attorney and sheriffs department refused to press charges. Who knows, you might get lucky, if you can prove it!
But I doubt it gets you very far with the custody issue, and it will get no traction in the divorce case. You are living with someone, and you are still married.

This is a VERY easy thing to prove. Marriages are public records. So are divorces.

And I'm going to bet that committing bigamy, which is not at all the same thing as shacking up with a partner, would not help her standing in court. Judges have this thing about breaking the law, and only a real idiot would get married before they were legally divorced.

Getting a marriage license is different than having a wedding theme-party.

This is all conjecture unless the OP can produce a marriage license.
