Prevent Last Minute Ex Parte Scam

Hi -

I am divorced finally, but I am still amazed how twisted the system is.

I am looking to prevent the last minute, "ex-parte", hearing scam by my ex. wife attorney's.

She attempted to set a court date within a two notice. In addition, she would then bill me for her ex. attorney's service.

My attorney did notified me, but it would have been too late to respond.

Luckily, I had a paper trail of paper of dates. For example, there was no need to send me to court, I had posted marked UPS papers to prove I there was no need to send me to court. My ex. pretty cocky about what she was doing, so I was prepared.

Most these attorneys work the same court house so it is hard to stop the additional billing garbage.

How can I notify the court to notify me first in the event of an, "ex-parte" hearing?

The court is El Dorado Superior Court house in California. I know many people out of that same court getting bleed to death for divorce fees.

I already had the restraining order scam and her attorney laughed when she hit me with it. I got out of that one, but amazed how easy it got filed.

I keep backups, on my cell, etc. That has been my only lifesaver.

You can't. That's the point behind ex-parte. The opposing counsel has something so urgent for the court to consider that notifying you in a timely manner isn't necessary.

If it wasn't urgent then it would have to be properly before the court with all parties being notified in advance of the hearing. This gives the parties some lead time to settle before the hearing and the court gets lead time to shuffle the paper work.

What's the urgent reason why the opposing counsel would ask the court for an ex-parte hearing?

If the ex-parte hearing makes the docket and it's available on the internet then use a service like changedetect.com or changedetection.com or software like websitewatcher to watch the docket for you. When it finds your name on the docket you get a message and can drive over to the court to insert yourself into the hearing. The problem here is that you'll be appearing without the benefit of counsel and that may screw things up even more for you (unless your attorney can show up at the court house with very short notice).

What my ex. claimed was that I refused to sign the deed of trust along with the credit card statements on time to the bank lender. She was attempting to refinance the home in her name.

She was aware I had sent the documents in, but they tried to make a case that I was refusing to cooperate. Her and her attorney attempted to set court date within a few days. They were so eager to throw me back in court, they did not bother to check the exact dates the lender received all the papers I had already sent.

My own attorney contacted me a week after the cancelled court date and still charged me for processing paper work. They court date never took place.

My ex. BTW, was looking to get reimbursed for her attorney fees of course. I would have had to pay mine as well.

Had I appeared in court I could have proven by the UPS dates of the paperwork, they had set a court date, without even checking any anything.

What is concerning is that her attorney was a prominent ex. judge. I have already seen enough dirty tricks from her to loss complete faith in the system.

A cornerstone of the system is playing fast and loose with your money. Without it, it would crumble.
