STBX personal injury settlement affect alimony??

My STBX will be getting at least 85k for an auto accident that happened during our marriage. She has refused to go back to work since asked 2 yrs ago when kids started public school. She has mba and a cpa license so underemployed by choice.


We are mediating alimony and equitable distribution may 18th. I am not entitled to but a minimal amount of her settlement for loss consortium. My attorney and I plan to hire vocational expert also to impute income.

Anyone know if her settlement will be counted as income? May 27th is the deadline to accept the offer from the insurance company.

What is the settlement for?

Loss of income? Pain and suffering? Disability?
Divorce is in the air. What should I do?

I found my answer. It is pain and suffering which will not be considered. She was and has not worked so no loss of income

Child support and property distribution are non-taxable but any other interest received from annuity payment is taxable. To which spouse the interest accrued goes to will be negotiated in the beginning of the set up.
