She will most likely get EOW and that's why you need the psych eval or at least a request and her refusal to participate. Your STBX needs to have supervised < parenting time > until she is medicated successfully, otherwise your children are in danger. That may already be clear to the judge, but with a psych eval in hand clearly explaining her current mental state and the dangers cannot be ignored. I would listen to your attorney.

I'll have to research the IL law, but I'm not certain if a psych eval is necessary, or optional. For instance, the GAL was basically forced upon us. They were like, "Ok, you guys NEED to pay for this..."
Are they gonna do that now, with a psych expert?
And the second part of that question is, would they say that WHILST demoting NJ to EOW?

And so evidently NJ even wrote to Governor Pat Quinn of IL, demanding to know why her EOP from Indiana is not being honored in IL. Governor's office referred her complaint over to the IL State Police, who wrote back telling her to basically stop running around IL waving an out of state EOP.
Interesting. But also sad, that I'm lucky enough to have what seems to be THE NJ of all NJs.

If your lawyer is pleading with you to do a psych eval you need to stop complaining about how come the system sucks for requiring one and get a psych eval done. It will likely be ordered on both of you and you may as the motioning party get stuck paying for both. If she refuses to cooperate, as some folks have said, FINE. Rantings in motions are not professional opinions given by a psychologist or therapist, and the law is that people can file just about anything.

If the judge is already pis$ed off, and the GAL will say you're the better parent, then a formal psych eval saying you have a few issues (we all do) but she's a raging lunatic will get you what you want.

Listen to your lawyer. Life isn't fair. Besides, what's the downside? You lose your children to a raging loon and get every other week.

Whoa whoa pump your breaks chief :D . I don't think the system sucks. Mom's get the benefit of the doubt. It just is what it is.
Also certainly doesn't help guys like us when dads like that guy recently, burn the house down with him and his kids along with it. So the system is a scale that does the best it can (hopefully) to weigh all things from people it's never met, as equally as possible.

Anyway. Reason, which I failed to mention, that I'm apprehensive for the court appointed psych eval, is because family services had her evaluated several months ago in which she allegedly "did fine."
Mind you I never received anything in writing from our case worker.

BUT, I hear what you're saying. And I'm afraid you're RIGHT. One way or another, this eval will probably need to be done, and hopefully it will be a real one, that actually bypasses HIPPA laws, and digs up her half dozen psych ward stints in the last 8 years :idea:
