OK So I did not win my Motion for Sanctions, such BS, but the STBX told the judge that she will have her Financials in by last Friday 4/13 but I have not heard anything from my lawyer.

So I'm stuck in limbo, I guess what comes next is mediation, I let my lawyer know that I want 65/35 with my son, I'm already doing that and I have documentation.

Question: If she does not get her Financials in, what can I do? Also I asked my lawyer to call her and let her know what I want before mediation, I really do not want to go to court.....Or do I? I do have a lot of documentation.

Any Thoughts?

My attorney just sent in an ex parte motion asking the judge to order my X to get in the financials in 10 days.

Ya that’s what my lawyer did as well and gave her 10 days and she never did it and the judge still did not make her pay. Go figure, I hate to sound sexist but I bet if that was me, he would have made me pay a fine. So unjust.

Maybe you should file a motion called, "Second Ex-Parte to compel after the first one wouldn't work and the judge would not sanction"

and in the motion ask the judge to let your wife know that he, "really means it this time or he'll wag his finger at the respondent and ask her nicely to comply"

My judge just approved the order to have her turn in her stuff in 10 days, but denied the attorney fees for doing it. I'm sure I'll end up in your situation soon.

My attorney got our ex-parte motion to compel discovery approved and the NJ still did not comply. Big surprise.

My attorney, whom I have growing respect for daily filed a motion to get a default judgement. I don't really understand all the issues, but we have a hearing soon on the subject. I'll let you know how it comes out.
