can you guys help me process this.

most know the story from other posts. son gets a scholarship to private hs, i have to pay 3k a year. i am responsible for payment. ex argues that money should go to paying kids expenses ie. health insurance, activities, camp and dental. the msa states we are to split those, she hasnt paid her half. last time we go in front of judge, judge orders financial discovery. i had a < edited > year and ex is paid in cash as fitness trainer.

ex wants to know how i am going to pay for 4 years of high school. she argues if i can afford hs she shouldnt have to pay for her half of kids expenses because she has no income.

i have had to file for bankruptcy because of all my legal fees from the custody battle 2 years ago so she will say to the judge how is he going to pay. i also have an outstanding balance with the irs due to sep-ira withdrawal penalties.

any thoughts?

Also, you may want to prove that she has income. In her situation it isn't really that hard.

Get someone (a PI, a friend) to call her up and ask her if she does personal training. Yes? How much?

Either that person can go to some sessions and pay your X, (by check), or ask for references that you can subpoena. When she lies in court about making money, and you prove even a little bit on the side, her credibility will be ruined.

What is your income? I have none.

Not even a little bit? No.

Aren't you in fact paid as a personal trainer? No.

Can you explain these canceled checks made out to you for personal training? Uh.....

From what I understand, ruining credibility like that can be very useful. Once you catch them in a lie, how is the judge going to say you don't have the ability to pay?

They'd be ignoring evidence and I don't think they will do that. Also, being lied to isn't very flattering.

These cash businesses all depend on word of mouth advertising. Easy targets.
