florida question abt extradition

Postby vtdad02 » Wed Feb 15, 2012 2:27 pm

Someone told me yesterday that Florida is the only state that will not extradite a mother and child back to another state for court. Does anyone know if this is true? I tried googling but wasn't sure where to start exactly.

Not true.

Though I've not heard "extradited" used in the context of family court before.

So if Nj skips out on a motion hearing and goes to Florida or some other state to live, they will find her and bring her back for contempt or whatever right? I'm sorry i am not fluent in all the legal terms!

IF a criminal warrant is issued in another state then she can and eventually will be arrested in Florida and returned to the home state of the warrant.

HOwever, civil court and criminal court are two different animals. Just because she doesn't show up for a contempt charge or hearing doesn't mean the fugative squad gets sent out to go get her.

Generally, if someone doesn't show it will mean the person that did gets what they request from the court. Typically known as a default order. That order can then usually be enforced in all 50 states one way or another after going through all the proper bureaucratic maneuvers. They really don't need the person there in court to rule against them and screw them to the wall. If you are persistent , the order can eventually be enforced.
