That's just it. When I told my attorney about my recordings she said they were admissible. But went on to say the judge isn't going to sit there and listen to long recordings. And on top of it all didn't even ask to hear any of them. Is it just me or are they using me to line their pockets heading full speed ahead toward a trial?

Well.. the town I am in is small. The courts are closed in the family court system here. They all seem to know each other and I keep seeing hidden communications flying back and forth in the courtroom. Such as the judge recommending the attorney's work something out in the FPO hearing..and small talk between the judge and her attorney..ect.. It's become obvious to me that this little country town is doing its own thing. I am starting to feel more and more this is a lose lose scenario for me. But I will fight.. I may go bankrupt but I'm not going to quit.

hopefully not such a small town that she has more important fish to fry. make sure you make appointments and understand where your attorney is on things. who would it hurt for her to listen to some highlights of the recordings or transcripts? i'd book a meeting when i had these type questions.

btw- the judge recommending you work something out is commonplace.


Aren't attorney's required to reveale any evidence prior to the final hearing in advance?

They're required to respond to discovery request. Thorough discovery is important so that there are no surprises at trial.

Attorneys don't settle.

Litigants do. Whether they settle or not depends on the quality of the evidence and the personality of the litigant but the vast majority of cases filed never go all the way to trial.

I received a letter from the victims advocate office today. I called them and they are very interested in all the evidence such as letters and recordings that I have. She is going to recommend to the prosecution that they delay the domestic violence until the divorce issue is settled. However the pre trial is set up for the beginning of april and the divorce hearing the end of april for the final divorce hearing.
For what it is worth she was shocked at such a precarious position the courts have placed me in given the circumstance. Again it comes back to the courts recognizing the bond between mother and child.

DV hearing yesterday.. NJ off the hook.. charges dropped.

Divorce case was settled.. not great but settled. DV charges were evident.. she admitted it to the police when she was booted. I don't know how or why they were dropped.. but I was informed of such.
