Should I pay Temporary child support?

STBX is moving out the end of July.


Should I offer and amount to pay child support? Not pay unless court says so? Should I call my attorney to have them calculate it and pay based upon calculations without alimony amount?

I think she will be motioning for temporary alimony as well.

What have others done? Could her attorney come back and ask for back child support later if I do not offer anything?

Yep.

The particulars depend on the state but if you know you have a kid and you know you should be paying support then in the states I've looked at that makes you liable for retroactive child support.

Why not have the kid stay in the home with you so you don't have to worry about that? She wants to move--let her leave. But the kid stays home.

In my case no back child support was awarded to my ex although her lawyer requested it in court. But this should have been expected as she disappeared with the children and took them out of state without filing for divorce. Then I dragged her sorry rear into court with a petition for allocation of parental responsibilities. She responded with a divorce petition. By the time we had a hearing she was demanding $9600 in back child support and alimony.

The judge said that my attorney should write up temp orders since I (first) petitioned for a hearing. They did not include back alimony or CS.

Moral of the story is kidnappers suck, and I think the judge thought that.

You are staying in the family home and have agreed to a 50/50 custody split. Don't pay any support. You have a decent chance at assigning your house as primary. Just make certain that you have your children at least 50% of the time, as agreed.

Florida doesn't have "Primary".

If it's due it is due and if you don't pay it now don't be surprised if you have to pay it later.

Preliminary numbers at my and her income and me pay 2k alimony is around $750 per month.

We have not agreed to anything but I guess august 1st I will pay around $700

The 2k alimony is my offer. I do not intend to pay that amount for temp support unless court orders it. I will pay the $700 though.
