Lifetime Alimony in Florida

Postby flalimony » Wed Jun 06, 2012 11:57 am

I was divorced in Florida. I was married 15 years and I am now divorced for 10 years. I got sentenced for lifetime alimony because the judge did not believe that she spoke English and I could not provide evidence that she worked under the table since we worked at her friends business.

I hope to have enough documentation on where she works this time to prove my case. I also got her bank accounts and she moves money in and out of her bank account all the time.

Has anyone had any luck in reducing alimony or eliminating alimony in Florida?

Does anyone have any ideas if there has been any positive outcome for not awarding lifetime alimony since the guidelines for permanent alimony changed to 17 years.

Has anyone had any experience in getting all of the necessary bank accounts from their spouse? I am submitting another request for the other accounts that she is transferring money into. IMHO she is doing the classic shell game with the money. Currently I can only see one of the shells but she is shifting the money in and out of that account.

Thanks in advance.

Hard to imagine someone could live in the US over a decade and not know English. When I moved to Brazil it took me about 5 months to speak Portuguese.

Unless your alimony is specifically "non-modifiable" you can always go back and try to terminate or modify.

Your story is sobering.
There are investigative agencies that will research and document all financial accounts. Do a google search on "locate hidden assets."
Good luck.

I'm not faced with alimony, so my advice is limited.

Does the amount of money she makes or doesn't make affect how much you have to pay? I didn't think alimony worked like that.

I'd be more interested in her romantic involvement. If she's living with someone or remarried you could try and get out of it that way.

I would read the statute to see if your case is even modifiable.

You need to see if the statute change in 2010 even applies to divorces that happened b4 the change.

Yeah she has been in the states for 26 years! She speaks English!

Alimony is based off of need. At looking at her bank statements it looks like she makes $4000 tax free (this does not include what I give her).

I checked the statues and as I read it I will not be able to get them to change it from permanent... but it looks like it can be reduced. I would hope $1.

(8) Permanent alimony may be awarded to provide for the needs and necessities of life as they were established during the marriage of the parties for a party who lacks the financial ability to meet his or her needs and necessities of life following a dissolution of marriage. Permanent alimony may be awarded following a marriage of long duration if such an award is appropriate upon consideration of the factors set forth in subsection (2), following a marriage of moderate duration if such an award is appropriate based upon clear and convincing evidence after consideration of the factors set forth in subsection (2), or following a marriage of short duration if there are written findings of exceptional circumstances. In awarding permanent alimony, the court shall include a finding that no other form of alimony is fair and reasonable under the circumstances of the parties. An award of permanent alimony terminates upon the death of either party or upon the remarriage of the party receiving alimony. An award may be modified or terminated based upon a substantial change in circumstances or upon the existence of a supportive relationship in accordance with s. 61.14.

I bet if you subpoena the people paying her they will squeal like a pig.

Might want to get an attorney if it means that much to you. You might have to make sure to subpoena there bank account records as well and do it properly and have it the day of court b/c that might be your one and only chance.

I bet money they are not paying her with dollar bills. There has to be a paper trail
