Never heard of that before. But, I'm still not sure I'm going to do bankruptcy yet. I want to see how this short sale pans out and then I want to see if VW or AMEX tries to pursue any legal action. Perhaps they are waiting for me to file bankruptcy, hoping I forget them and then they swoop in to collect. Nah, that would be too much thinking....

Have you put a lien on her car? Is her tax return going to get garnished that you know of. Bk attorney would want to know this heading into one.

I was a special case, so I was told. I have 15g's in equity in my house and 25g's equity in my vehicles. Now I have to pay back the 40 I'm trying to get rid of in unsecured debt. But in the long run its going to save me 90g's in interest.

I paid off her car when we divorced and that was her alimony. That was the best $9000 I ever spent. But, the car is a POS now. She fugged it all up. Tons of dents, never waxed, hubcaps missing and it's probably not even registered or insured. She still has PA plates, even though she hasn't lived there in five years.

Yup, I checked PACSES and she has a lien against her. I called to verify and they said her tax refund will be garnished if she files her taxes. We'll see if that happens.

If I were you, it all depends on the house. 22k isn't too bad, especially because you can make deals like you were offered.

If you end up owing much more, I think I'd file.

Just wanted to add-
My ex racked up more on the credit cards than I brought home in a year. That was 6 years ago, and so far as I know, she never paid anything on them. They offered to settle for half the amount; I don't know if they eventually went lower. The thing that just gets me is, no one ever sued her or really tried to collect. Most of her cards had 5 or 6 thousand dollar balances apiece, and they just gave up, from everything I can see. Maybe they'll finally come after her in the future...

Anyway, I guess what I'm getting at, is maybe you don't need to file for bankruptcy just yet. My ex seemed to get away scott free by just not paying. :|

My x did the same thing. I had a joint account with her that she was ordered to pay. She just went dark on them for years, and by now I guess she can have the credit bureaus remove the records cos they are ten years old. There was never a judgment and I don't think the credit card company can do anything now. The amount was about $10k and by the time I stopped seeing anything from them it had compounded to over $25k. I haven't heard a peep from them for years and yes, they are still in business. These days it costs companies a fair amount to collect, and the ROI is quite limited when the debtor doesn't give a rip about her in-the-toilet FICO score. Or mine.

Interesting. VW just sent me a settlement offer of 25% off, which brings the balance from $7200 to $5300. I still can't pay it but this is interesting. Maybe they will go down to 50%.

They either know I can't pay the debt and are hoping that I send them some money or they have a zillion cases to deal with and are using the "dropping eggs" approach.
