Question about credit for extra < parenting time >...

Postby scottbrake » Thu Mar 15, 2012 4:09 pm

Divorced for the past 4 years. Our papers never specifically stated an actual < parenting time > schedule. Just says 50/50. Joint custody with mom having physical custody.
Since the day our divorce was final my ex wife will only take our daughter 3 days a week. I don't mind AT ALL. What I do mind is that basically I'm supporting my daughter at MY house and her mom's house.
Papers say I do get a credit for having my daughter 184 days. But it's way more than that. I also only get the tax exemption eoy.
Our ratio for wages is 80(me) 20(her).
I have worked tons of overtime this past year and I'm afraid if I go back into court to rectify this that my support will increase. Also I am paying afterschool care 5 days a week. My ex hasn't worked 5 days a week in 4 years. She leaves my daughter at school until 5:45 on her 2 days of < parenting time > just because she can. And I'm paying for it by a court order. I have no clue what to do but I'm going broke.

How solid are your records that you have more than 184 overnights?

Document, document, document your primary status and file for modification to get the orders to accurately reflect reality. Then your only child support issue will be how to collect.

There is no denying it. Same schedule for 4 years. But I do document. I have since the divorce.

Pre school records can be gold as to what days and time they get picked up.

Yes the after school daycare has her signature on the two days that she picks her up. Doesn't work on those days but leaves her there until 6:00pm. On my dime. I pick up the other 3 days and sign her out. But I come straight from my job.

Is the reason you have not filed previously just general apprehension or is there some other reason?

Dead bodies in the closet?

:edited to add. What state is this in? I seem to remember at least one where the CP will still end up paying CS to the NCP when there is a big income difference.

I was told to document for as long as I could. Never had any issues besides this. I recently went on vacation and had to provide care for my daughter on my days because my ex wouldn't help out. Not even a day.

Why didn't you take her with you? Then you don't need to worry about who is going to take care of YOUR daughter.

Well I was in Las Vegas seeing Motley Crue. Didn't think it was appropriate to take my 9 year old daughter. I have taken my daughter to Disney AND Mexico in the past year. Am I not entitled to a vacation with my wife? My sister watched my daughter on the days that I was gone. I was only gone for 2 nights. Geesh!!!
