Almost 1 Year And NJ Is More Hateful Then Ever

Going on 1 year of having custody of son, NJ left the relationship to be with internet
BF which hurt but things have slowly started to get better.

NJ has not made any support payments in a year and is has been unemployed for over a year.

I was given possession of the marital home as she left state for 3 months to be with BF and return with him, her 0 financial status allowed me to put her on a payment plan which she gladly agreed to, i make her sign it every month when she takes the agreed upon payment i've done this since december for her share of the proceeds of the house based on 40k, this allowed me to keep my home for my son and I to live at least for a couple more years.

The decree stated she will be provided a car until lease expired and i limped through it and now NJ has no transportation and is fuming again saying in a week or 2 i will be back in court. there had been a relapse in insurance and the tabs didnt get renewed 10 days prior to the car being turned in. which of course has me very concerned.

I dont know how this would play out in court if she actually does take me back, but from her vocabulary she is obviously being educated by some one.
and what would the judge say.

Any ideas of how i should present this if brought up..


The vehicle seemed to be community property with her boyfriend to drive.

"Tabs being renewed?" If you are referring to car registration and insurance, there is nothing to worry about from a 10-day lapse...unless she was in an accident or something else that made you liable.
With a decree in place, you should not be responsible for support beyond what is specified.
P.S. You need a competent lawyer to handle your case. Your writing is tricky to follow.

No harm occurred, based on the story you related. Tell your attorney to have the NJ prove that she was somehow financially damaged by the tags being 10 days late. The judge will listen to her ranting and simply reply "Pfffffftttt".

That's a phrase they teach them to say when they're in law school that basically means "no $hit, Sherlock, but no real damages occurred." But, because it would be impolite for them to say that from the bench, they just make a "Pffffffttttt" noise instead. :lol:

Seriously, they have to present evidence of genuine financial harm. If they can't, it's just a wasted trip to court. BTW, be sure to tell her that you will counter-sue for attorneys fees for this frivolous lawsuit.

Case in point...my X, through horrible bill-paying practices, trashed my FICO score with 3 years of late mortgage payments, every month. I argued that for the next decade, every loan I would need would be given at high interest rates because of her recklessness. However, it got nowhere because I hadn't been actually declined for credit (knew better than to even try).

Pffft is right.

There are 2 types of people in the world, those that collect interest, and those that pay it. Why get a loan at all?

My divorce trashed my credit, but I'm saving up 25K in cash in case I need a new car down the road, mine is 4 years old. As far as houses go, I like the one I have.

That sounds like the wisdom of the trust fund beneficiary or the cable tv finance guy with high blood pressure. Nice that you enjoy your house. You paid cash for it, I guess. Most of us have to borrow in order to have homes. Most have to borrow to go back for a Master's degree. And most have to borrow for cars.

Wages have stagnated in this country for at lest 3 decades. And banks are increasingly difficult, except if it's your ~$9B they are gambling and losing. Everyone knows it's better to pay cash; I do it most of the time. But very few people in this country never borrow.

I say there are three types of people...those who never need to borrow, those who can't borrow if their lives depended upon it, and the overwhelming bulk of people who need to borrow for big-ticket items. You could add a fourth, those who choose to pay interest for getting what they want/need now rather than waiting for it until they've saved up. Don't assume the bulk of people do this now like they did in the 80s.

Or a 5th, those who use credit to float money, and collect rewards for spending money, yet don't pay interest.

I was in that category until assets were frozen and I took on some debt to pay for attorney. Not big debt, but paying interest on $3k does kinda suck.

Can't wait til she's gone and I don't need to worry about that anymore...
