She cannot unilaterally make the decision regarding daycare. And the longer I live close to the daycare and spend extra time with D3, the harder it will be for NJ to ever relocate to a new city - if thats even in her plans anymore.
When I start back school, all 4 classes will be on Tuesday and Thursday leaving Monday, Wednesday, and Friday wide open. I plan on spending a lot of extra time with D3. NJ can't really say anything because she will be working.
This is the same ex that made innuendos of "sexual allegations" about your dad or step-dad, right? This is the same ex that has made deals with you regarding switching weekends and then backed out and screwed you (and your brother), right? This is the same ex that got pregnant before the divorce was even final and just recently had her baby, right? This is the same ex that cancelled surgery on your daughters ear after you both agreed to the necessity, right? This is the same ex that took your daughter to a play therapist without your consent, right?
Do you really think she won't hesitate to pull your daughter out of daycare if it is more convenient for her, or just because it would screw you? Your only recourse at that point would be to take her back to court for changing daycares, and I doubt the judge is going to give a rat's as$ about something so minor. It is not a custody changing event (unlike a move by the ex 3 hours away).
Maybe it is a non-event and your ex wouldn't even think to pull her out of daycare because she is scared of what will happen if she doesn't follow the order to a T. I think you are still putting too much faith in your Ex. Don't give her more ammunition to screw with you.

I don't know where you live, or how long it takes you to drive 5 miles. I do know that I wouldn't move over a 5 minute car ride. I cant see where you'd gain much time with your D now vs a 2 minute drive if you move.
Stay where you're at for another month or until her lease is up, then you'll know what move to make.
Thanks to advice from this board; I ended up with 50/50 parenting time, kept the house, car, truck, boat, toys, all my 401K, and 1/2 our savings.
It is really about 9 miles. I have to travel through town and a lot of stop lights. It takes about 20 minutes to get from my house to her house. Her school is even further.
I'm moving no matter what because my lease is up on the 3 br I am in now. I am moving to a 1br by myself about 1.5 miles from D3's school.
NJ's boyfriend/babydaddy/mealticket is going down to Orlando to go to school. He plans on coming up on the weekends. So since NJ will finally know what its like to live on her own with little to no help. my hopes are that I will be able to see my daughter a whole hell of a lot more.
