If u read the other thread...."I called cops today...." you know what happened. At 9pm just now I was served with a TRO because she fears for her safety. I spoke with my attorney already and I just want to see my son. Hearing is for next week where I guess I'll be presenting my evidence(audio recordings). Looks like this is war.

You are right.....I wanted to file this morning but my attorney said I would have to prove it, so I didn't. Just like she can't prove it but now I'm the loser....I'm listening to the audio recordings from yesterday but I can't be objective. There doesn't seem to be any altercation that she alleges....only a variation of the truth. I won't be able to see my son for awhile. That is the most painful part of this.

Do you know what an elevator pitch is?

In the 30 seconds you might get in an elevator ride with a venture capitalist, you have to sell yourself and your idea.

You need to work on your elevator pitch for the Judge, because you will have about 30 seconds to interest him/her in your side of the story. You can't plan on a lengthy hearing with audio recordings, transcripts and 8x10 color glossy pictures with little arrows and captions on the back. You have about 30 seconds to show the Judge you are a reasonable person who acts in a reasonable manner, and a Super Dad.

In all likelyhood, he/she will grant the TRO - because of one fellow 18 years ago, OJ Simpson. Only a very rare exception will prevent a TRO from being granted.

What you want is a plan for the kids to be exchanged, information to be exchanged and mutual restrictions - she can't do anything that you can't do. You want to recover your property from the house immediately, before she has a chance to jack with it. You want to have equal parenting time . . . . you want to establish now that life that you expect after you are divorced.

Have you checked your banking accounts?

I have no valuables in the condo.....my safe was removed last month...we have no mutual credit cards or bank accounts or anything financial. I'm a physician and I have my own office so I can pay myself whatever I want and work flexible hours for my son, but I do need to pay myself enough to cover bills. I think the financial problems most guys have with their stbx are covered in my case.

Hey ortho.....I'm pain/pmr....the attorney situation is that I just switched back to this guy this morning because he is more available and is aggressive, and when she served me divorce when my dad was getting chemo I realized she was ruthless. I had originally seen him but then chose a female attorney because I thought he was TOO aggressive. If he wouldn't have somewhat convinced me out of getting the TRO this morning and me having an office full of patients this morning maybe I'd be sleeping in my own bed. But I'm sticking with him cuz I like him and he only does divorces.

Yes I want the max which is probably 50/50. She doesn't do drugs or anything like that so its unlikely I'll get more.

Counter petition against her. Work on a detailed supporting affidavit for your attorney. Reference the recorded incident of family violence. Quote only her voice.
Should send a chill up her spine and will give her something to lose.
Also include the incidents you mentioned of her increasingly volatile or threatening behavior.
A mutual order or winning is better than simply defending against her false accusations.

I obviously can't sleep....my iPad is my journal. I've been working on my journal over the past week before this even happened. I've been working on my 30 second statement to the judge tonight. She said in the TRO that I'm 6'2" 230lbs.....off by 3" and 35 lbs.

Do u guys suggest handwriting your journal, or is technology ok?
