Texas Custody HELP!!!

Postby the savvy1 » Mon Apr 23, 2012 3:53 pm

I have been married (technicaly now for 9 plus years) We have (2) children together. A 2 and 7 year old. I decided to seperate one year ago and filled for divorce 6 months ago. Since I work and the ex does not, I have the kids on the weekends, typically Fri evening through Sunday late afternoon. She has failed to sign the paperwork and is insisting on moving the children back home to Oregon . We live in Texas. What do I do? I have paid all of her bills to this point since moving out. Had the kids when the work schedule is not in the way (Some Saturday work). Being closer to family would be great for them but, it is out of the question for myself as the economy is horrible there and I could not find a job at the level I am currently. My largest fear is the fact that the ex will get on state assistance and I do not want my children to be in that environment. I cannot be without them. What do I do?

read the list. get a lawyer?
stop talking to her unless it is about the kids or her with the kids?
was your petition acknowledged?
if so, it might be a good idea to set up a temp orders hearing, establishing you as primary, her with the over 100 miles state minimum < parenting time >[she pays travel], exclusive occupancy of the marital residence. maybe you can establish what she could earn and she should be required to pay a portion of that in order to help with the financial support of her children.... I am kinna new here too so these are just my thoughts.

you should come up with day care arrangements. my point is have her served immediately and get the ball rolling in Texas. Oregon is beautiful and all but you need to ask someone who knows both Oregon and Texas family law. "Which state is more lenient to the father?"

Oregon will pound you so hard you will want your mama. Do not let her go a lawyer can stop that in most cases. If she goes on state aid they take over and you will put your lawyers kids through college.

Yeah - also where is the temporary order for support? Any money you give her is not credited and just gifted. And get a temporary custody parenting plan filed.
