STBX can't pay her attorney

What's going to happen?


Divorce filed June of 2011.

My attorney has helped me avoid two Temporary Restraining Order hearings, a Temporary Orders hearing and two Final Hearings.

STBX's first attorney promised her all sorts of stuff he couldn't deliver and the STBX get fed up and fired him in November. She constantly called the poor guy and he was probably happy to see her go. She even managed to get a large chunk of her retainer refunded. (The original retainer was paid by her Mom.)

In November she hired a fancy new attorney and paid them a retainer of $3,500. They filed an amended petition and served me with an extensive discovery request.

The day before the most recent Final Hearing the STBX got a call from her attorney's office asking her to pay $2,000 that she told them she doesn't have. Interestingly enough, the hearing got postponed later that afternoon because her attorney was "sick".

The Final Hearing has been re-scheduled again and her attorney sent an invoice "due and owing" to be piad before the next hearing.


How is this likely to play out? What's the odds that her attorney will drop her for non-payment?

I still haven't used up the $2,500 retainer I paid my attorney.

This is your chance to go for the GOLD = sole custody, the house, everything.

File a Motion to Shorten Time before she can hire another attorney. Kick your stbx to the curb.

Never show mercy.

If I were you I'd consider making an offer via letter from your attorney to hers.

Offer the following:
-A very one sided favorable to you settlement (see above)
-Include a clause that says you will pay 2k towards her attorney fees

The idea is to give the person she trusts (her attorney) an incentive to advise her to take the deal.
