Supervised < parenting time > for Newly Recovering Alcoholic

Postby nclark » Tue Mar 22, 2005 12:14 am

Due to my wife's recent suicide attempt using alcohol the court might grant my Emeregency Motion for Sole Legal and Physical Custody. My wife will have supervised < parenting time >.

If the Order is entered, I assume that it will then be her burden to show that there are changed circumstances warranting a change in custody arrangements. If my wife continues her physchiatric and addiction therapy and maintains sobreity, I envision changing the custody arrangement. I am intrested in hearing from those who have had custody orders modified depending on the non-custodial parent's compliance with rehabilative services. What sobreity milestones did you set (30 days sober, completion of out patient re-hab program etc.).

My ex has had professionally supervised < parenting time > for about a year now due to her addiction to prescription drugs. We reached an agreement with her attorney that if she does the following, she can use her mother as supervisor.
1. Submits to random monitored drug tests including hair within 2 hours of receiving a phone call from the psychologist who did the evaluations.
2. Completes a 3 months drug detection patch program
3. Gets a complete copy of her prescription history sent to the psychologist. (this may not be available in your state).
4. Pays for all of it.
5. Obeys all existing court orders
6. Continues psychotherapy for her antisocial/narcissistic personality disorder.

So far she has done almost all of it. I'm hoping she doesn't finish it because in my case the mother is dangerous to the kids. In your case I'd request proof of participation in weekly AA meeting, random monitored alcohol tests, and whatever else you can think of for at least 6 months, if not a year. Ask your attorney what the norm is for that particular court.

Court ordered a temporary Order w/o prejudice giving wife 2 hrs supervised < parenting time > during the week, 2 hours Sat and Sunday (incrased to 3 hrs next weekend and 4 hrs the weekend after that. I get access to all docs related to wife's recovery efforts.

Wife's drug and alcohol counselor will recommend when wife is ready for increased time with kids. We can consider counselor's recommendation but it is not binding on us in anyway. Temporarily got what I wanted. .
