Smartphone recording

I had purchased a new phone a while back, and decided that I would give it to my wife, which I suspected of cheating on me, but installed software on it to record chats and phone calls (not audio, just numbers and length of call) and photo's takes, and GPS.

within just a few days I had proof that she was sending nude picture and "sexting"on it.

Since then I have filed for a divorce and she has taken our children and left to another city.
Now I am using it to determine her whereabouts so that I can get her served.

Now, I am worried that it will come back to haunt me, she is alleging that I was abusive, which I am not, and has filed a temporary restraining order on me.

I live in Texas, and was wondering if anyone had any suggestions or feedback.
The phone is in my name, but with the allegations what can/ should I do?

I do not want this to hurt my case...

Don't let her know and don't give her reason to have her phone checked.

This. Go over all the information you have, and see if you can come up with other, plausible, legal ways you could have obtained it. If you can't find a way to have gotten a piece of information that will look less fishy, hang on to it, but don't let anyone (other than maybe your attorney on retainer) know you have it.

You need to file with the court for immediate return of the children to the marital residence. What she has done is parental kidnapping and is illegal in Texas. Let the law do IT'S job and find her to arrest her or just bring the children back, but don't allow this to go on...............
